Shine Pages Brand Kit Service Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using ShinePages Brand Kit design service ("Service"). These Terms govern your relationship with ShinePages as a user ("User" or "you") of the Service. By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Description of Service

ShinePages provides a semi custom logo design services to individuals and businesses.

• The Service includes the re-styling of our stock designs based on the User's specifications and requirements.
• Brand Logo in the following formats (black and white transparent .png, .jpg, .svg, .eps)
• Brand Palette with pre-selected colors (1 primary and 4 secondary colors) 
• Brand Fonts - 3 coordinating fonts files to be used as Primary Header Text, SubHeader/Body Text, Accent Text

Design Requirements

• Logos will be a re-styling of the stock design example chosen by the user
• ShinePages will provide a brand palette from the available color palette options chosen by the user
• Select fonts can be swapped for ShinePages selection of available fonts
• ShinePages will remove graphics but not add any graphics to the original design.
• Only "free" unlicensed fonts will be used in the design.
• ShinePages will not provide custom graphics, color schemes, or fonts.
• ShinePages does not provide revisions to brand kit packages
• Additional revisions may be requested by the user, it is up to the discretion of the ShinePages design team if requests can be honored and will be subject to an additional fee.
• Refunds will not be provided.

Intellectual Property Rights

All intellectual property rights, including copyright and trademarks, in the logo designs created by ShinePages shall remain the property of ShinePages unless otherwise agreed upon in writing. Upon the User's full payment for the logo design, ShinePages grants the User a non-exclusive, non-transferable license to use the logo design for the User's intended purpose.

User Obligations

By using the Service, you agree to provide accurate and complete information regarding your logo design requirements. You acknowledge that any delay or failure to provide necessary information may affect the quality and timely delivery of the logo design. You also agree not to submit any content that infringes upon the intellectual property rights of third parties.

Payment and Pricing

Payment for the logo design service shall be made in advance according to the agreed-upon terms and methods.

Revisions and Refunds

Additional revisions may be requested by the user, it is up to the discretion of the ShinePages design team if requests can or will be honored and will be subject to an additional fee. Refunds will not be provided.

Confidentiality

ShinePages will treat all information provided by the User as confidential. ShinePages will not disclose any confidential information to third parties, except as required by law or with the User's consent.

Limitation of Liability

To the fullest extent permitted by law, ShinePages shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Service. In no event shall ShinePages total liability exceed the total amount paid by the User for the logo design service.

Termination

ShinePages may terminate or suspend the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms by the User. Upon termination, the User's right to use the Service will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or in connection with these Terms shall first be mediated before any court filings. 

Modifications

ShinePages reserves the right to modify these Terms at any time, effective upon posting the updated Terms on its website. Your continued use of the Service after any such changes constitutes your acceptance of the modified Terms.
